Cannot the military deploy to repel a foreign invasion?
The Posse Comitatus Act was passed to limit federal involvement in domestic policies. This is quite obviously an international event.
Note also, the Act, despite being amended several times over the years, does not explicitly mention the United States Navy, the United States Marine Corps nor the United States Coast Guard. All three services can operate legally along the Rio Grande or any other body of water separating our country from another.
The Marines can be deployed anywhere there’s a threat.
Maybe if we forcefully repelled some of these illegals it would send a message.

“There are a number of situations in which the Act does not apply. These include:
Army and Air National Guard units and state defense forces while under the authority of the governor of a state;
Federal military personnel used in accordance to the Insurrection Act, as was the case during the 1992 Los Angeles riots.
Under 18 U.S.C. § 831, the Attorney General may request that the Secretary of Defense provide emergency assistance if domestic law enforcement is inadequate to address certain types of threats involving the release of nuclear materials, such as potential use of a nuclear or radiological weapon. Such assistance may be by any personnel under the authority of the Department of Defense, provided such assistance does not adversely affect U.S. military preparedness. The only exemption is nuclear materials.
Support roles under the Joint Special Operations Command
Enforcement of federal law at the discretion of the President of the United States, such as with the 101st Airborne Division by President Dwight D. Eisenhower to integrate Little Rock Central High School in 1957.”
It’s obvious that the President can and probably should deploy troops on the border, and he does not need Congressional approval.
It’ll be interesting to see what happens.
Around this time 50 years ago the 82nd. Airborne Division was deployed to Washington DC to help put down the riots caused by the death of Martin L. King.

Wouldn’t that be because Washington DC isn’t a state and has no national guard? I would think that and the territories would be the exception.

Hugh, the Posse Comitatus Act cannot prevent the Federal government from deploying troops anywhere in the country for various reasons as I mentioned above. (see: Insurrection Act)
The situation on our border is entirely different, as an international situation. Posse Comitatus doesn’t apply in the border situation.
In any event, the Feds do have the power to deploy Military troops regardless of the States position.(see”forced integration of schools in Little Rock 1957).
I’m not judging whether that’s good or not, just stating the law.

Several presidents have deployed troops to the border. What I remember about those instances was that the troops could not arrest anyone, they were in the middle of nowhere with no ammunition for their weapons and when the drug mules came armed and ready for the fight, the troops had to stand aside.
Our border wall is now comprised of our flesh and blood.
