Lex Mala, Lex Nulla and Some Drama

The new crop of congresscritters of the 116th Congress will be seated on January 3, 2019. The Democrat Party has regained its majority, and now we can only look on with dread anticipation at their follies. Be forewarned: The whole concept of their being our elected representatives and actually harkening to the will of the electorate is something that seems quite foreign and antique to them. They no longer make even the pretense of genuine representation. They are headed to DC with an agenda. Their stated plan to topple Nancy Pelosi from her Speaker of the House position is indicative of their fervor. This, before they’ve even been through their freshman orientation! Clearly, the statists want to pass a lot of bad laws, and they will do anything and everything in their power to make that happen. If they have to cheat, lie, wheedle, posture, pontificate, cajole, prevaricate, threaten, bribe, or blackmail their peers to make it so, then surely they will. That is how 21st Century Democrats and their RINO Fifth Columnist pals operate.

We must face the sad fact that the U.S.House of Representatives once again has a Democrat majority. In addition to a long parade of contrived congressional investigations of the Trump administration, the Democrats are planning to ramrod numerous pieces of civilian disarmament legislation through committee to the House floor. They’ll start by reviving moribund pieces of legislation that had previously died in committee. Even Dianne Feinstein’s proposed “Assault Weapons” ban will probably come up for a floor vote. (Believe me: The only “assault” going on will be a an assault on our individual liberty!)

A word of warning: If they cannot pass these laws individually, then they will bundle them up into omnibus legislation packages, hoping to get them enacted by default or by inattention. Under the guise of “common sense gun control laws”, they will attempt to remove an entire class of firearms from production or importation for civilian ownership. I also expect them to bundle a national “Red Flag” gun seizure (aka Extreme Risk Protection Order) bill into an omnibus “gun control” legislation package.

The horrible Gun Control Act of 1968 (GCA-68) is an example of an omnibus legislative package that was steamrollered into law. Its full title was: “The Omnibus Crime Control And Safe Streets Act Of 1968.” It is codified in Title 42 of the U.S. Code. Among many other things, GCA-68 made it illegal for private parties to sell or transfer guns across state lines. It may sound absurd, but if I were to give one of my out-of-state my nieces or nephews a gun as a gift, it would be a felony if I were to do so without handling the transfer through a Federally-licensed dealer. Bad laws like these must have our Founding Fathers must be rolling in their graves!

 

Lex Mala, Lex Nulla

There is an old legal maxim that is often quoted: “Lex mala, lex nulla.” This Latin phrase means “bad law is no law.”  More precisely, we should quote Saint Augustine, who famously wrote: “Lex iniusta non est lex.”  Which is most commonly rendered in English: “An unjust law is no law at all.”

Sometimes it is important to take a step back and look at a micro situation (like any particular legislative bill) from a macro perspective. I’ve quoted the following gem from American Jurisprudence before, but it is important to repeat it here:

“The general rule is that an unconstitutional statute, whether federal or state, though having the form and name of law, is in reality no law but is wholly void and ineffective for any purpose. Since unconstitutionality dates from the time of its enactment and not merely from the date of the decision so branding it, an unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed and never existed; that is, it is void ab initio. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

Since an unconstitutional law is void, it follows that generally the statute imposes no duties, confers no rights, creates no office or liabilities, bestows no power or authority on anyone, affords no protection, is incapable of creating any rights or obligations, does not allow for the granting of any relief, and justifies no acts performed under it.

Once a statute is determined to be unconstitutional, no private citizen or division of the state may take any further action pursuant to its provisions. A contract that rests on an unconstitutional statute creates no obligation to be impaired by subsequent legislation. No one is bound to obey an unconstitutional law, and no courts are bound to enforce it. A law contrary to the United States Constitution may not be enforced. Once a statute has been declared unconstitutional, courts thereafter have no jurisdiction over alleged violations. Persons convicted and fined under a statute subsequently held unconstitutional may recover the fines paid.”  [JWR’s Emphasis Added.]

To maintain a free society, bad laws must be annulled, overturned, or otherwise stopped.

 

Rosa Parks Moments

We of course have to pick our fights wisely and not foolishly tilt at windmills. But when a fundamental right is violated by a bad law–or under color of law–then someone needs to make a firm stand. On a personal level, this can be costly.  Most people cannot afford to pay for extended legal battles. Most of us who have charge of families cannot afford to lose our jobs and face incarceration. So count the costs before you make any fateful stand. But if you do, you can take heart in the knowledge that we now live in the Internet Age. Your struggle will not go unnoticed. They can’t stop the signal. Being the guinea pig in a test case is never comfortable. However, in the face of a genuinely bad law, someone needs to volunteer. Every freedom-loving nation needs exemplars like Rosa Parks to make a stand for liberty. The true Rosa Parks Moments for our nation have been few and far between. These are dramatic turning points in our nation’s history, often initiated by just one stalwart citizen making a stand.

Alcohol Prohibition ended 85 years ago, primarily because of massive non-compliance. The Federal ban on marijuana is presently being rendered ineffective by decades of massive non-compliance followed by state legalization. In 10 States and even in Washington, DC, marijuana has been legalized for recreational use for those 21 and older. And now medical marijuana has been legalized in 33 states. Regardless of your opinion of The Wacky Tobaccy, we must recognize that this is a prime example of a societal sea change, through Constitutional processes.

In sum, the Lex Malum can be eliminated several ways:

  • Polite pressure on legislators with calls, letters, and speaking up at Town Hall meetings.
  • Individuals simply flouting laws (non-compliance).
  • Non-enforcement by conscientious officials.
  • Jury nullification.
  • Launching test cases. (Read: “Get yourself arrested and probably face prison.”)
  • Lobbying.
  • Filing Title 18:241, 18:242, 18:245, 18:247, and 18:14141 lawsuits.
  • Public rallies and protests.
  • Civil disobedience.  (Read: “Get yourself arrested — on a misdemeanor.”)
  • And as an absolute worst case, recourse to the force of arms.

The last on that list, at its core, is what the 2nd Amendment guarantees.

Of those methods I listed, test cases are the most time consuming and frustrating. Some cases take decades to work their way up the chain in the appeals process. Frustratingly, the Supreme Court can decline to hear cases, for a variety of reasons.

 

A Law-Abiding Nation

With few equals, the United States is a nation of law-abiding citizens. For generations, Americans have been raised to respect the law. In recent years, this innate respect has gradually transitioned to fear. William Shakespeare once famously wrote:  “Thus conscience does make cowards of us all…”  But in our modern age, I submit that it is the law that makes cowards of us all. I urge my readers to be brave in the face of unconstitutional laws. Make a stand for what is right. Again, it may come at a great cost and personal sacrifice. But always remember that we are Americans, and in the end we collectively can be trusted to do what is righteous. Also remember that We The People are the sovereigns.  If we recognize God’s authority, we are still the final arbiters of our national destiny.

I’ll close with a quote from Congressman Larry McDonald: “There are four boxes to be used in the defense of liberty: the soap box, the ballot box, the the jury box, and the ammo box. Please use in that order.”  If you think that Rosa Parks Moments are full of drama, then wait until you witness a Battle of Athens, Tennessee Moment.

Lord help our nation if we ever have to resort to opening that final box. – JWR

  1. Thank you for this. It is the unpleasant truth that ultimately, the enforcement of the law, meaning the constitution, rests squarely on us, the people. The government is our employee, and they have gone wrong. It is our job to pull them back. The government won’t fix itself. Unfortunately, the majority of the population is asleep, either from drugs (legal or illegal), food prompted illness, or indifference from indoctrination from government run schools. I am encouraged that there is a remnant who understand English common law, that down through history, time and time again, it was the people who had to pull back their freedom from tyrants who would seek to rule over them. Our constitution is the product of over 1000 years of English common law. Look up Kris Anne Hall’s video, Genealogy of the Constitution. It’s fascinating.

  2. The constitution is dead. All of government, at all levels, violates it at will 24/7. Few fight back. The people have never read it. Nobody knows what it says and nobody cares. A contract that nobody has read and nobody follows is no contract at all. The constitution is null, void, and of no force or effect. I’m not advocating for this condition. I’m not happy about it; I’m merely living in reality. It’s over. The covenant is broken. Proceed under God’s Natural Law. You have a King James Holy Bible. That’s the only law a man needs. We were warned that it was only fit for a moral and religious people, as was Moses when his Father in Law gave him the republican design of government, by God. There is no thing and no one to blame but look only straight in the mirror. We have the blood of 70 million dead babies on our hands. We are unfit. He will not stay His wrath forever.

  7. If the DNC can do all these nefarious things to American citizens with a solid GOP Senate and the power of President that can veto anything the DNC House comes up with than why bother to vote GOP at all.

    However we have the Presidency, the Senate that will confirm more judges and we have a 5/4 Supreme Court.
    Please take a breath or switch to decaf but the GOP has more than enough power to kill off DNC insanity.

    Romans 13:1 clearly shows all government authorities are established by God.

    1. Sadly, we have a President who has already caved-in on the issue of Red Flag laws. He is also a consummate “deal maker.” If he finds that he can’t get his Wall built because of the Democrat-ruled House of Representatives, I fear that he will compromise with the Democrats on civilian disarmament.

      Look at the relevant verses again.

      Closely.

      It says that rulers are not a terror to good works but to evil works. It goes on to say “do that which is good and you’ll have praise of the same”. Does that sound like our government today?

      Ask the Christian bakery owners how that went for them.

      If a government or “ruler” does not live up to the picture painted in Romans 13, then that government (ruler) is illegitimate.

  8. Sir, unfortunately your words are meaningless in a court, whether state or federal. I know thru personal experience. Quoting the law to a court is useless. The courts are no longer and haven’t been for a long time, courts of law. While your article may educate us folks in fly over country it does nothing for judges and congress. I recently was involved in a court process in the state of arizona in a superior court. The court ignores anything you have to say or it does not want to hear. I pointed out to the court in a motion for clarification attempting to clarify that it’s order against me for “good cause,” that it had opined no law, had no witnesses offered against me by the ag. The court will not even respond. The courts are now allowing the “system” to be a witness. So if you have an error in a data base alleging something against you, it is accepted as TRUTH. They are allowing the opponents lawyers to be a witness. They are allowing civil servants to be a witness without making a sworn statement. They are not only violating God’s law in Lev. 5:1 but the law they swore to uphold. Maybe that’s why they no longer require sworn testimony–if the judge is corrupted in not holding to the law, why should the judge require anyone else to hold to the law. Congress has failed in supervising the courts and the courts do what they want. ” …and every man did what was right in his own eyes.” As a christian i know whats coming and that these self-righteous people will be Judged, but i don’t have to like the tribulation part only the end result! As to your suggestions on how to combat these lawless people, writing to you congressperson is useless. They are apathetic to us common folk. Fortunately, many civil servants are their-selves apathetic about doing their job, so many people who are challenging their lawless behavior are ignored to our benefit. Jury nullification would work but the courts do not allow you to have a jury of your peers and if you contest you are ignored. We are in a bad situation.

    1. I will concur with you that the judicial system is, in a manner of speaking, in my words, a rogue organization. But we have discovered, over time, much of what you experienced, while you thought/presumed you were in a true court, an Article III court, is that you were standing before a judge that in fact was functioning at the time as an administrative official and not a true judicial officer.

      I am familiar with several people who have learned to play the game in such a manner that they place that black robed admin. officer in serious corner with several demands; demands which the court must meet or be shown to have no jurisdiction.

      It is sad, and equally repulsive to us who have discovered their, govt’s, little secrets that we should even be faced with their dealing with us so corruptly and fraudulently.

    If the election of President Trump is now a lost cause, the appointments of Judges throughout the US is meaningless, and keeping the Senate that approves judicial nominees, cabinet positions and treaties is for not worth nothing.

    And if you are right James it means voting for anything is a waste of time, money and energy.

    However for me and my family will just trust The Lord. We are a long way of having a Nero leader and Christianity exploded in that time frame.

    Lastly, as a historical point of view President Obama had a super majority in both Houses and yet he did not ban guns. Why?

We may have a brief break in their assualt on the constitiuion for two years but what just happened on the mid-terms is just a practice run for 2020. Although the RINOS are not very reliable and may cave in the senate from media presuure.The Dems stole at least 17 house seats after election day. They almost stole Florida and Georgia’s governor’s races and Florida’s senate race. Montana and Arizona are highly suspect Dem wins. In 2020 they’ll steal Florida and Texas and there goes Trumps Electoral college edge. I’m old and probably won’t see the ultimate destruction of our nation but pray for my kid’s and grandkids, who don’t get it either. At least half of the people in this country are lik the frog in the pot of water that is slowly coming to a boil after 2020. God help us all.

  12. Romans 13 is clear. It’s “all” Authority is established by God. This means all governments throughout time are under the sovereign control of God

    13 Let everyone be subject to the governing authorities, for there is no authority except that which God has established. The authorities that exist have been established by God. 2 Consequently, whoever rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgment on themselves.

    We live in a blessed time in this nation. I for one look at the positives now and not the “what if’s” in the future.

    1. Skip- i have to disagree with you on yours and many others interpretation of Romans 13. In my opinion he was writing to pagan Romans who were becoming christians and joining the messianic community. I think the “chaptering” and versing of his letter adds to the problem. His instruction was that God established the leadership in the messianic community (thru elders, deacons, etc.) or what is now called the church. This idea of “church” leadership in spiritual matters was foreign to the Romans. He would have no need to tell romans to obey the roman leadership since they were already roman citizens. Romans 13:3 reads that these rulers are not a terror to good works but to evil. I know God created evil but I don’t think He wants us to put up with it. I think King James asked his translators to continue the concept of the “divine right” of kings. Well he was paying!

        Romans 13 Speaks of law and government as in The Word Of God and the brand new Christian Church. The change came during the rewrite of the bible and the birth of the catholic church. This put Romans 13 more in line with the thought of the Pope and kings. In order to rule the peasant population.

  13. We are not yet at the point of a hot war against the Socialist takeover. But we are teetering on the edge. The first stages were the elections of 2010, 2014, and 2016. We should- and I urge you all to- wait, however impatiently, to see what changes can be made by President Trump and his team. I realize that he does not yet have control of the engines of power- the Department of Justice, the FBI, and the CIA. But look at what he was facing. The recent elections were a mixed bag. Forty-four RINOs decided NOT to seek re-election in the House and were replaced. Replaced by it looks like 40 socialists and 4 on our side. Even though the loss of a majority will mean the loss of Chairmanships, and massive amounts of phony investigations against Trump, the remaining Republicans in the House will not be devouring our power from within our camp. We may be able to reorganize and regain ower- after all, every member of the House will face re-election again in only two years.
    In the meantime, our position in the Senate is stronger. Confirmation of judgeships may prove to be slightly easier. And judgeships is where the REAL power lies in the government.
    IF things do not improve, or drastically get worse, we still retain the option of armed rebellion. But let’s not be hasty to begin this LAST, most horrible option.
    Give our President a full term to see what he is able to do. And work your butts off to insure that he is re-elected. Give peace a chance. If peace FAILS, we will certainly know it by the worsening of our lot. THEN it will be time to attack mercilessly. But that time is NOT YET HERE.
    FOR NOW, we must be as meek as doves and as wise as serpents. Prepare for war, plan for war, steel yourself for war, but work for peace.

    1. Nathan; I second what you have said. Trump is doing what he can. We all wish he would do more or even something different but it is such an improvement over the last president it gives me some hope. I would also add that things change and sometimes they change quickly. Until the 2020 election we won’t know what the situation is. I fully expect that the Democrats will over step themselves and we may again have the congress.

    Soap Box: just listen to the US media TV print online and hollywood. We have lost that box.

    Ballot Box: 2016 a corrupt woman won more votes than Trump did, only the electoral college pulled that one out. House vote was lost and senate got by only by the skin of their teeth. We are losing that box.

    Jury Box: This box has been lost for a long time.

    Ammo Box: Better stock up boys and girls because they are either going to ban or tax ammo out of reach of the common man in the US.

  16. When I was a child, I would accompany my grandfather into the spring fields to hoe weeds. He educated me on the Constitution… the Republic and what it meant to be a good citizen.

    He was a man unafraid to take a stand. As a member of the “America First” movement, he fought tooth and nail against America becoming entangled in the growing butchery in Europe. That stalwart opposition resulted in his being arrested and tried in federal court.

    Frank Knox was Alf Landon’s running mate on the 1936 Republican ticket. In 1940, Knox was nominated and confirmed as Roosevelt’s Secretary of the Navy. Believing Knox had abandoned the Republican Party, my grandfather sent a postcard, addressed to “Secretary of the Navy Frank Knox, the Benedict Arnold of 1940”. He was arrested by federal agents, put on trial for defamation of character and threatening a government official. He was acquitted by a level-headed jury. My grandfather said that such arrests and trials were common in the period leading up to Pearl Harbor as a way to stifle opposition to Roosevelt’s foreign policy. From that time on, he always had a pistol handy.

    To put his 1940 outrage into perspective, we need to recall that the 1940 Republican National Platform included these words… “The Republican Party is firmly opposed to involving this Nation in foreign war.. . . We are still suffering from the ill effects of the last World War: a war which cost us a twenty-four billion dollar increase in our national debt, billions of uncollectible foreign debts, and the complete upset of our economic system, in addition to the loss of human life and irreparable damage to the health of thousands of our boys.”

    I have never forgotten one prediction Grandpa made when LBJ defeated Barry Goldwater in 1964. He told me… “This election marks the beginning of the end of The Republic… you will probably see politicians hanging from lamp posts before it’s all over.”

  17. A lot of talk gentlemen. I am weary of reading it. I am not interested in writing senators who betray us with excessive compromise; even while Republicans control the Senate. I am not interested in whose verse interpretation is most applicable, or reading how some of you are ready with your guns. I am not interested in reading it because it is not convincing. Unless the next betrayal of our Constitution is answered by most of us and thousands of others marching on D. C. and demonstrating outside the appropriate government building neither I nor our politicians nor the unsure Americans will take you seriously. Demonstrations are not a tool typically used by conservatives but they can work for us also. Anyone willing?

    1. Old John- what are you DOING to organize a protest ? Probably NOTHING. I do not mean any disrespect to you, but anyone can write a letter saying that there should be a protest demonstration, but FEW will actually do anything to get one to happen. If you feel so strongly that a protest will do any good, YOU must get off your butt and ORGANIZE one. I have done this before. You must write to dozens or hundreds of organizations, clubs, civic groups, forum members, and interested parties, and get commitments from them to participate. You must decide on a date, and time, and plan logistics- which may include co-ordinating transportation, lodging, food water, sanitation, as well as the tone and content that you want to convey to the general public, the targeted politicians, and the press. You must do the work-IF YOU ARE REALLY WILLING- or it will NOT get done.
      YOU must put your money and your time we your mouth is. I wish you the best of luck.

    So-called ‘patriots’ are obsessed with the 2nd Amendment. Yet the Republican’s NDAA destroyed our Bill of Rights? Not one shot was fired. That was 7-1/2 years ago. With the exception of Bundy Ranch standoff obviously no one is willing to exercise it.

    Patriots may have hundreds of millions of guns and metric tons of ammo but the question is do they have anything they will fight for?”

  19. A representative must be a naturalized citizen for at least 7 years before holding office. I wonder how that works when 40 dems and 2 reps have dual citizenship.

    1. True enduring courage is a character trait of the godly when they fear God more than men. We have not come to that point yet because so many are fearful of doing something that might cost them something. They do not realize that they have already lost all those things so precious to them. When the hour comes when we must stand for right no matter the cost, will we? Of Lord, be merciful to your people and grant them both humility and repentance and courage and endurance.

    As to the comment God created evil is not true. What is true God will end mankind’s evil permanently.

    1. I’m not a Biblical scholar by any means, far from it… but I do recall on one hand, Jesus saying, “Render unto Caesar the things that are Caesar’s, and unto God the things that are God’s”…

      On the other hand, he did “overthrow” the system at the time, when he threw the money changers out of the Temple… physically, by force… Although some say he only whipped the live stock to drive them out, not the money changers.

      (As an aside, my “arms” don’t belong to Caesar either, so, I think I’m just gonna hold on to them for the time being.)

    2. Skip- Are you saying that the American Revolution went against the teachings of Jesus ?
      I sincerely doubt it, when you examine the religious and more specifically the Christian writings of the founders and in our founding documents.
      Jesus did not preach revolution- at least not in the context of revolt against a government, but his teachings do not preclude it either. His teachings pertained to the spiritual not the temporal.
      On a related subject, the admonition to turn the other cheek does not mean we should not protect our families and our friends and neighbors from slaughter. I am a Believer in Christ Jesus, but I am also an American. I don’t see how one precludes the other. The early Christians saw themselves as Christians AND Jews. Paul (Saul) saw himself as a Christian. But as a Roman citizen, he presented his argument before the Roman authorities, although unsuccessfully.
      And before you say it, I do not believe that Romans 13 means that we should give up our right to self defense, go along with the murder of a million babies each year, or approve of Sodomite ‘marriage’, either, just because the GOVERNMENT demands it.
      I hope we can still be friendly, and work together, even if we don’t see eye to eye on everything.

Today there was a tiff between Trump and Justice Roberts about “Obama judges.” Roberts, who lives deep within the “Deep State,” of course had to defend the party line declaring that there are no “Obama judges” or “Trump judges”, etc. They’re all very unbiased and high minded, extremely educated and only dedicated to the Constitution (uhhh, just forget about Ruth Buzzi Ginsberg saying that the South African Constitution was superior to the US Constitution, OK?)

    Roberts is a very smart man. I seriously doubt he actually believes this horse hockey. Of course there are “Obama judges.” Every one that has popped up from obscurity to block Trump’s executive orders has been an individual that was chosen by Obama for his Left wing credentials. Obama is, in effect, still running the country through his specially chosen radical judges. Saying these guys are Constitutional experts is kind of like saying a car thief is an Automotive Engineer.

    He covers a succinct explanation of the Constitution, a little history and how we drifted from the original structure. He also discusses the role of SCOTUS in the disintegration of the system. He has an excellent, engaging writing style. I can’t praise it highly enough.

    A quote from the article: “I call the present system “Post–Constitutional America.” As I sometimes put it, the U.S. Constitution poses no serious threat to our form of government.”

    (Some will recall that Mark Levin has used the phrase “post-constitutional America”, but this article was written sometime in the early 2000’s)

    This one is under-rated… and this is what the Left does all the time, and they get away with it…

    There’s a time for talking and a time for acting. If you get enough people who stand their ground and simply say no, there aren’t enough courts or police to control everyone.

    I’m not talking about shooting anyone… just be prepared to tell the judge, “sorry your honor… I’m a peaceful law abiding person, but I’m not giving up my guns… they’re hid where you’ll never find them. And then be prepared to go to jail.

  23. Nathan Hail, I was expecting more comments like yours. You are right! I have not tried to organize a demonstration before. Because it would need to be big to be effective it probably would be best to get organized before the trigger event(s). I have read your post in the past and if I am remembering them right they were on point and insightful. You indicate that you have experience, are you willing to help at least by sharing your experiences with me? How many of you others would be willing to participate if something were properly organized and the subject of the protest was something you favor?

    1. Old John- thank you for your reply. The protest that I organized was motorcycle riders against a helmet law. This was many years ago. I wrote to about a hundred motorcycle groups, clubs, dealers, and other groups for about a year beforehand. Most, except for the clubs did not even respond. Apathy. The idea was for riders to ride from all over the state and meet at the state capitol. However, the state legislators totally ignored us and went on to approve the helmet law anyway. I am not a professional, and maybe that was what was needed. Maybe I should have tried to lobby the legislators instead. I don’t know. Anyway, I can tell you that it was a lot of work. It ended up being for naught, but I thought that it had to be done. If you do plan to organize something, please let us know how we can get your contact information. Maybe some of us can help.

    My comments concerning Scripture are based on the simple fact that Almighty God rules and establishes authorities anywhere HE wishes.
    It is clear in the Old Testament as it is in the New Testament, God Rules period.
    And one day soon HE will judge mankind for who belongs to Jesus Christ and who does not.

    Almighty God also tells us not to lean on our own understanding but trust Him.

  25. The silent majority remains mostly silent in regards to the second amendment.
    I doubt that they will remain silent if the socialists in fact start confiscating guns and ammo.
    What is actually taking place by the socialists is death by a thousand paper cuts as regarding the second amendment.
    Example: The 2018 election in Illinois was won by a supermajority of democrats in the state house and senate and defeated the republican governor with a democrat. 38 counties had passed by ballot votes to be gun sanctuary counties. The democrats had already proposed 5 legislative bills with severe anti-gun bills prior to their election but could not get them passed because a republican governor would just veto them. One bill that will be reintroduced is making it unconstitutional therefore illegal for any Illinois county or local state government to make their jurisdiction a sanctuary gun jurisdiction.

    Our fight is against principalities and powers in high places, always has been always will. We need to have clear focus we are arguing the wrong argument.

    1) Form legal state militias. Constitution verbiage is militia. We are losing the argument to mass shooting by civilians killing civilians with military (which they are not) type weapons. Need to give patriots a legal organization to be members of that is legitimate in matching what local law enforcement has been supplied with.

    2) Petition the state and federal government to arm the state militia individual membership with modern weaponry just like local law enforcement has received.

    3) its all about elections, the effort needs to be specifically towards that end.

    4) The militia membership needs to be involved in election politics in getting out the vote the progressive left is killing us in that regard. It will give us strong political power and voice. They don’t have an argument against a state militia.

    We are losing the argument boys and girls. all they have to do is tax guns and ammo and concealed carry. they don’t even have to ban them they can tax-ban them.

My two cents: I am living back in Kalifornia again temporarily due to unforseen circumstances, but my point is, that the people of this state are mostly conservative, mostly God fearing, and mostly armed to the teeth. The fact that SanFran, LA, and Silicon Valley have swung hard left since the days of Reagan, doesn’t erase the fact that the majority of the actual land mass is filled with kindred spirits. There are more unregistered weapons than registered here. Call it civil disobedience. We are the silent majority. I assume much of the country is also quietly biding the time, quietly preparing, resolutely so. And yes we voted en masse. Election fraud is a thing here (esp in LA). We don’t need publicly organized militias. But we do need to hold fast to our convictions, our Faith, our guns. We are Woke. Just quiet about it. Sometimes laying low is the best option when living in enemy territory.

I liked the part of the article which discussed non-compliance with unConstitutional laws…but I’m not sure how it could possibly apply in the case of a full on “assault weapons ban.” There is absolutely nothing anyone can do to restock the store shelves with high capacity magazines and their semi-auto counterparts. I seriously doubt that the good people at Smith & Wesson or Colt are going to run the blockade and begin shipping banned firearms to their distributors. We older folks have lived through the 1994 “Clinton Ban”…and believe me, there is nothing you will be able to do about it…short of importing weapons from overseas smugglers.
